1. Introduction

Welcome to Pinnakle Properties. These Terms & Conditions outline the rules and regulations governing your relationship with [Your Company Name], including services provided under the Rent-to-Rent model for House in Multiple Occupation (HMO) properties.

By using our services, you (the "Landlord") agree to comply with these terms. Please read them carefully.


2. Definitions

  • Company: Refers to Pinnakle Properties, registered at 20 wenlock road, London N1 7GU.
  • Landlord: Refers to the property owner who engages Refers to Pinnakle to provide Rent-to-Rent HMO services.
  • Agreement: Refers to the contractual agreement between the Company and the Landlord for the Rent-to-Rent services.
  • Property: Refers to the premises owned by the Landlord and subject to the Rent-to-Rent agreement.
  • Tenants: Individuals occupying the Property under a tenancy agreement managed by Refers to Pinnakle .
  • Guaranteed Rent: The fixed monthly payment agreed upon between the Landlord and the Company, regardless of tenant occupancy.

3. Services Provided

[Your Company Name] offers the following services under the Rent-to-Rent model:

  • Guaranteed Rental Payments: We guarantee monthly rent payments to the Landlord as outlined in the Agreement.
  • HMO Property Management: We will manage the property as a House in Multiple Occupation (HMO), including tenant sourcing, rent collection, and day-to-day operations.
  • Compliance Management: We will ensure that the Property meets local HMO licensing and safety requirements.
  • Maintenance and Repairs: We handle minor maintenance and repairs as agreed upon in the Agreement. Major repairs remain the Landlord’s responsibility unless otherwise stated.

4. Landlord Responsibilities

The Landlord agrees to:

  • Provide Accurate Information: The Landlord is responsible for ensuring that all property-related information provided to the Company is accurate and up to date.
  • Insurance: The Landlord is responsible for ensuring that the Property has adequate building insurance and landlord insurance in place throughout the duration of the Agreement.
  • Major Repairs: The Landlord is responsible for structural and major repairs, including but not limited to the roof, walls, windows, and major plumbing issues, unless otherwise agreed in writing.
  • Legal Compliance: The Landlord must ensure that the Property is legally compliant with all local laws and regulations before entering into the Agreement, including obtaining the necessary HMO license where required.

5. Rent Payments

  • Guaranteed Rent: The Company will pay the Landlord the agreed fixed rent each month, regardless of tenant occupancy or void periods, as outlined in the Agreement.
  • Payment Schedule: Rent will be paid to the Landlord on the 1st of each month, as per the agreed schedule.
  • Rent Reviews: The guaranteed rent amount may be reviewed and adjusted annually or as otherwise stated in the Agreement.
  • Withholding of Rent: The Company reserves the right to withhold rental payments if the Landlord fails to meet their obligations under these Terms & Conditions.

6. Property Condition and Maintenance

  • Initial Condition: The Landlord agrees to hand over the Property in a safe and habitable condition, with no outstanding major repairs.
  • Minor Repairs: The Company will be responsible for minor repairs, such as changing light bulbs, unblocking drains, and replacing fixtures and fittings.
  • Major Repairs: The Landlord is responsible for major repairs that affect the structural integrity of the Property, including plumbing, electrical, and roofing issues.
  • Access for Repairs: The Landlord agrees to allow access to the Property for repair works, either by the Company or third-party contractors.

7. Term of Agreement

  • Duration: The initial term of the Agreement is [3/5] years, as agreed upon. The term may be extended by mutual consent.
  • Termination by Landlord: The Landlord may terminate the Agreement by providing 6 months’ written notice after the minimum term, provided that all obligations under the Agreement have been met.
  • Termination by Company: The Company may terminate the Agreement at any time if the Landlord fails to meet their obligations or if the Property becomes unsuitable for HMO use. Pinnakle Properties will provide 3 months' notice in such a case.

8. Liability and Indemnity

  • Limitation of Liability: The Company’s liability is limited to the amount of rent due to the Landlord under the Agreement. The Company will not be liable for any consequential or indirect loss, including loss of profits or income.
  • Indemnification: The Landlord agrees to indemnify and hold the Company harmless against any claims, damages, or losses arising from the Landlord’s failure to comply with these Terms & Conditions or applicable laws.

9. Insurance

  • Landlord Insurance: The Landlord is responsible for maintaining appropriate landlord insurance, covering risks such as property damage, fire, flooding, and third-party liability.
  • Contents Insurance: The Company will not be liable for the loss or damage to the Landlord's contents, furnishings, or belongings unless caused by the Company’s negligence.

10. Compliance with Laws

Both the Landlord and the Company must comply with all relevant UK laws and regulations, including:

  • HMO Licensing: The Landlord is responsible for ensuring that the Property has the appropriate HMO license in place.
  • Health and Safety Regulations: The Company will ensure that the Property is compliant with all health and safety standards, including fire safety regulations, gas safety, and electrical safety.

11. Dispute Resolution

  • Informal Resolution: In the event of any disputes arising under this Agreement, both parties agree to attempt to resolve the matter amicably through informal negotiation.
  • Formal Resolution: If an informal resolution cannot be reached, the dispute may be referred to mediation or arbitration under UK law.

12. Data Protection
